Public Offer (Terms of Sale)

This document is an official offer by Individual Entrepreneur Dmitrii Vladimirovich Baskakov (the “Seller”) to conclude a service agreement on the terms below, addressed to any individual or legal entity (the “Customer”), in accordance with Articles 435–437 of the Civil Code of the Russian Federation.

1. Definitions

  • Service — email address validation performed by CleanContact via the API or the Personal account.
  • Validation — a single request to the service that results in determining the characteristics of one email address.
  • Credit pack — a pre-paid number of Validations, not limited by any validity period.
  • Subscription — a committed daily Validation volume billed monthly.
  • Personal account — the Customer's private area where plans are purchased and usage is managed.

2. Subject

The Seller grants the Customer, for a fee, the right to use the CleanContact service for validating email addresses under one of the plans published on the pricing page of this website: pre-paid Credit packs or a Subscription for a committed daily volume.

3. Acceptance

Payment for a plan constitutes full and unconditional acceptance of this Offer. From the moment the payment is received, the agreement is deemed concluded on the terms of this Offer.

The Seller may refuse to conclude the agreement or terminate the provision of the Service in the cases provided for by this Offer and the legislation of the Russian Federation.

4. Prices and payment

  • Current prices are published on the pricing page and are stated in Russian rubles.
  • Payment is made through an authorized payment service; the Customer's bank card details are processed by the payment service and are not transferred to the Seller.
  • A fiscal receipt is issued in accordance with Federal Law No. 54-FZ and sent to the email address provided by the Customer.

5. Provision of the Service

Access to the service is provided via the Internet.

Purchased Validations or the Subscription volume are credited to the Customer's Personal account after the payment is confirmed, normally within a few minutes. Access to the purchased services is provided through the Personal account. The Service is deemed provided as Validations are performed at the Customer's requests.

The Seller may carry out maintenance work, temporarily restricting access to the service.

The Seller may modify the API, response formats and technical parameters without degrading the essential consumer properties of the Service.

The Seller may impose technical limits on the number of requests, the rate of API calls and other parameters of service usage necessary to ensure its stable operation.

6. Use of the Service

  • The Customer undertakes to use the service only in accordance with the legislation of the Russian Federation and not to use it for unlawful activities, mass attacks, disruption of third-party services, or violation of the rights of third parties.
  • By transmitting email addresses for validation, the Customer confirms that it has legal grounds for their processing and for their transfer to the Seller.
  • The Seller may restrict or terminate the provision of the Service upon detecting abuse, attempts to disrupt the operation of the service, or use of the Service in violation of this Offer.

7. Intellectual property

The exclusive rights to the software and the service belong to the Seller. This Offer does not grant the Customer any rights to the source code, software, trademarks or other intellectual property, except for the right to use the Service.

8. Refunds

  • The cost of completed Validations is non-refundable.
  • The Customer may submit a refund request for the unused volume of Validations or the unused part of the paid Subscription period within 14 calendar days from the date of payment.
  • After this period, refund requests are considered by the Seller on a case-by-case basis.
  • The request shall be sent to the email address dmitry@bask.ws.
  • The refund is made using the same payment method that was used for the purchase, unless the parties agree on a different method.
  • The request is reviewed within up to 10 calendar days.

9. Liability and warranties

  • The Service is provided on an “as is” basis.
  • Validation is performed using the Seller's own algorithms and data of third-party mail systems. Validation results are informational (probabilistic) in nature, do not constitute a guarantee of the existence of a mailbox, of the deliverability of email messages, or of the absence of subsequent blocking of the address. The Seller does not warrant the absolute accuracy of Validation results.
  • The Customer makes the decision on how to use the Validation results independently; the Seller is not liable for the consequences of such use or for indirect losses.
  • The Seller's aggregate liability for any claims of the Customer is limited to the amount actually paid by the Customer for the relevant Service during the last 12 months.

10. Force majeure

The parties are released from liability for partial or complete failure to perform their obligations under this Offer if such failure results from force majeure circumstances, for the duration of such circumstances.

11. Term and changes

The Offer is effective from the moment it is published on this page and until it is revoked. The Seller may amend the Offer by publishing a new version; the terms in force at the moment of payment apply to that payment.
